1. Contractual Relationship
1.1
These Terms of Service constitute a legally binding agreement (“the Agreement”) between you and
(HUSTLE), an organization headquartered in Saudi Arabia - Jeddah - Prince Mohammed Bin Abdulaziz
Street - Baghlaf Curve Building, Wasel National Post 9049, 23334. Commercial Registration No.
(4030316537) To it by expression (HUSTLE, “We”, or “Us”), This term includes (our legal
representatives, our administrators, allies of interest, authorized, assignees and affiliates).
This Agreement governs your use of the Applications, Website (s), Call Center, Technology
Platform, Content, Products and / or Services. Provided by (HUSTLE).
1.2
Granted (HUSTLE) - in many countries - The license to operate the platform (HUSTLE) to related
affiliates, our affiliate in your country gives you the right to access and use the (HUSTLE)
platform within your country. In the absence of any of the subsidiaries (to HUSTLE) While using
the platform (HUSTLE) itself is available to you, you have the right to access and use (HUSTLE)
platform from our organization in Saudi Arabia.
1.3
User access and use of the Services constitutes User agreement to be bound by these Terms, which
establishes a contractual relationship between User and (HUSTLE). If User do not agree to these
Terms, User may opt to not access or use the Services. These Terms expressly supersede prior
agreements, understanding or arrangements with User. (HUSTLE) may immediately terminate these
Terms or any Services with respect to User, or generally cease offering or deny access to the
Services or any portion thereof, at any time for any reason without prior notice.
1.4
Some supplementary conditions may apply to certain services (as described below), such as
policies for an event, loyalty program, activity or promotion, and you will be disclosed about
these supplementary conditions in relation to the services provided.
1.5
These Terms (Agreement) relating to the Services may be amended (to HUSTLE) from time to time
Amendments shall be effective following publication of (HUSTLE) These Terms (Agreement) are
updated on this web or publishing amended policies or supplementary terms relating to the
service provided. Your continued access to or use of the (HUSTLE Platform) after this posting
constitutes the user’s consent to be bound by the Terms as amended.
1.6
Our collection and use of personal information in connection with (HUSTLE platform) is in
accordance with the privacy policy of (HUSTLE) Which can be found by visiting the following
link: (https://hustlesa.com) permissible for (HUSTLE EST) Provide necessary information,
including user contact information, to claim settlement companies or insurance companies in the
event of a complaint, dispute or disagreement, This may involve an incident between the user and
an external service provider (including a driver in a transport company) where such information
or data is necessary to resolve a complaint, dispute or disagreement.
2. HUSTLE Platform
2.1
(HUSTLE) platform provides a digital network that acts as a shopping site where people (“users”)
seeking personal transport services or delivering goods, products, restaurant meals or logistics
(“services”) can correspond to the people referred to as (“partner”). Who can provide services.
Each user must create a user account that enables them to access the platform (HUSTLE). Any
decision made by the user with respect to the use or acceptance of the Services is at his or her
sole discretion. Each service provided by the Partner to the User forms a separate agreement
between the User and the User.
2.2
The Services constitute a marketplace online platform that enables Users of (HUSTLE’s) mobile
applications or websites provided as part of the Services (each, an “Application”) to offer,
sell, buy goods and/or arrange and schedule deliveries, logistics and/or transportation services
with independent third party providers of such goods and/or services, including independent
third party delivery providers and independent third party transportation providers under
independent contractor agreement with (HUSTLE) or certain of (HUSTLE’s) affiliates (“Partner”).
2.3
The actual contract for sale is directly between the seller and buyer and (HUSTLE) is not a
traditional auctioneer. While (HUSTLE) may provide pricing, shipping, listing, sourcing, and
other guidance in the Services, such guidance is solely informational and User may decide to
follow it or not. Also, while (HUSTLE) may help facilitate the resolution of disputes, (HSTLE)
has no control over and does not guarantee: the existence, quality, safety or legality of goods
advertised; the truth or accuracy of Users’ content or listings; the ability of sellers to sell
goods; the ability of buyers to pay for goods; or that a buyer or seller will actually complete
a transaction or return a good.
2.4
Unless otherwise agreed by (HUSTLE) in a separate written agreement with User, the Services are
made available solely for User personal, noncommercial use .
2.5
User Acknowledge That (HUSTLE) does Not Provide Deliveries or Transportation Services or function
as a Delivery Provider Or Transportation carrier and That All Such Deliveries Or Transportation
Services are provided By independent Third party Contractors who are not employed by (HUSTLE) or
any of its Affiliates.
3. License
(HUSTLE) grants you, subject to the user’s commitment to this Agreement, a limited,
non-exclusive license that cannot be transferred to the Operating Department and cannot be
transferred to any third party, whether directly or indirectly, and / or subcontract able, for:
(A) access to (HUSTLE platform) and use on the user’s personal device only in relation to the
user’s use (HUSTLE); And (b) access to and use of any content, information and related materials
that may be provided through (HUSTLE platform), and in all cases the use is personal and
non-commercial only. Any of the rights not expressly granted herein shall be retained by
(HUSTLE) and its licensors.
4. Restrictions
User may not: (i) remove any copyright, trademark or other proprietary notices from any portion
of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute,
license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream,
broadcast or otherwise exploit the Services except as expressly permitted by (HUSTLE); (iii)
decompile, reverse engineer or disassemble the Services; (iv) link to, mirror or frame any
portion of the Services; (v) cause or launch any programs or scripts for the purpose of
scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly
burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi)
attempt to gain unauthorized access to or impair any aspect of the Services or its related
systems or networks.
5. Provision of the Services
5.1
User acknowledge that portions of the Services may be made available under (HUSTLE’s) various
brands or request options associated with delivery, transportation or logistics which currently
referred to as “HUSTLE”.
5.2
User also acknowledge that the Services may be made available under such brand or request
options by or in connection with: (i) certain of (HUSTLE’s) subsidiaries and affiliates; or (ii)
independent Service Providers, including transportation network company drivers, transportation
charter permit holders or holders of similar transportation permits, authorizations or licenses.
6. Services and Content of Third Parties and Independent Service Providers
6.1
The Services may be made available or accessed in connection with Independent Service Provider
and third-party services and content (including advertising) that (HUSTLE) does not control.
6.2
User acknowledge that different terms of use and privacy policies may apply to User’s use of
such Independent Service Providers or third party services and content.
6.3
(HUSTLE) does not endorse such Independent Service Provider or third party services and content
and in no event shall (HUSTLE) be responsible or liable for any products or services of such
Independent Service Provider or third party providers.
6.4
Apple Inc., Google, Inc., Microsoft Corporation or BlackBerry Limited and/or their applicable
international subsidiaries and affiliates are third-party beneficiaries to this contract if User
access the Services using Applications developed for Apple iOS, Android, Microsoft Windows, or
Blackberry-powered mobile devices, respectively.
6.5
These third party beneficiaries are not parties to this contract and are not responsible for the
provision or support of the Services in any manner. User access to the Services using these
devices is subject to terms set forth in the applicable third party beneficiary’s terms of
service.
